Employers that hold certain FAA certificates (under 44704 or 44705) and their contractors, subcontractors, or suppliers must not fire or punish a worker for raising air‑safety concerns or taking part in safety actions. Protected actions include giving safety information to the employer or the federal government, starting or filing a safety-related action, testifying in that action, or helping someone else with the action. If a worker thinks they were punished for those reasons, they can file a complaint with the Secretary of Labor within 90 days. The Secretary will tell the employer and the FAA and must investigate, usually within 60 days, after letting the employer respond and meet with a Labor Department representative. The worker must show the protected action was a contributing factor in the bad job action. The employer can avoid penalties only by clear and convincing proof it would have taken the same action anyway. If the Secretary finds a violation, the Secretary can order fixes, including stopping the violation, putting the worker back with back pay and restored job conditions, and paying damages. Either side can object within 30 days and ask for a hearing; a final order must be issued within 120 days after the hearing. If a claim is frivolous, the employer may get up to $1,000 in attorney fees. Orders can be appealed to the U.S. Court of Appeals within 60 days, enforced in federal court, and the FAA may assess penalties under section 46301. A worker cannot use these protections if they deliberately caused a safety violation while acting on their own without direction. A non‑discretionary duty under the law can be enforced by a mandamus action under 28 U.S.C. 1361.
