Title 49 › Subtitle SUBTITLE VII— AVIATION PROGRAMS › Part A— AIR COMMERCE AND SAFETY › Subpart iii— safety › Chapter 447— SAFETY REGULATION › § 44742
The head of the FAA must keep working to stop or reduce any interference by an ODA holder that hurts ODA unit members from doing their authorized jobs. If a supervisor at an ODA holder that makes transport category airplanes interferes with an ODA unit member’s work, that supervisor breaks the law and can be fined for each violation under section 46301(a)(1). The FAA can also use other enforcement tools it has. ODA unit members must quickly report interference to the ODA holder’s office set up to take such reports. That office must investigate and send the results to the FAA office the Administrator names, following rules about how, when, and in what form to report. “Interference” means either clear abusive behavior (like harassment, berating, or threats) meant to improperly affect duties, or non-ODA tasks or activities that conflict with ODA duties. Definitions in section 44736(c) apply.
