The TSA Administrator can deputize a state or local police officer to do federal airport security work. To do this, TSA must sign a voluntary agreement with the officer’s agency. Deputized officers are treated as federal law enforcement for meeting airport security requirements. TSA will pay the agency for all reasonable, allowable, and allocable costs for the deputized officer, and money may be appropriated as needed to do that. While working under federal supervision and the deputization terms, the officer is treated as an “employee of the Government” for sections 1346(b), 2401(b), and chapter 171 of title 28, United States Code. TSA may also allow these officers to be posted away from the screening area if they can still respond quickly to problems.
