The Administrator may give security screening machines to a foreign last point of departure airport operator if the machines are likely to reduce a specific threat to the United States or U.S. citizens. Before giving any equipment, the Administrator must return the machines to normal commercial settings, remove any TSA-only standards or algorithms, and confirm the recipient can operate and maintain the machines and can record and track any removal or disposal so the machines do not fall into terrorists’ hands. Not later than 30 days before a donation, the Administrator must send a written report to the Senate Committee on Commerce, Science, and Transportation; the Senate Committee on Homeland Security and Governmental Affairs; and the House Committee on Homeland Security explaining the exact threat being addressed, why the recipient can’t buy the equipment, an evacuation plan for sensitive technology if the country becomes unstable, how the equipment will be used and kept up, the total dollar value, and how removal or disposal will be documented and tracked.
