You may only operate a civil subsonic turbojet airplane that weighs more than 75,000 pounds and was brought into the United States after November 4, 1990 if the plane meets "stage 3" noise limits or if the importer bought the plane under a binding contract made before November 5, 1990. The Secretary of Transportation can allow an exemption so the owner can modify the airplane to meet stage 3. A plane is not treated as newly imported if, on November 5, 1990, it was owned by a U.S. corporation/trust/partnership (including the District of Columbia), a U.S. citizen, or an entity owned or controlled by those, and the plane enters the United States no later than 6 months after a lease to a foreign carrier ends.
