§48108 — Title 49 Transportation | U.S. Code

Summary

Money authorized by sections 48101–48105 must stay in the Airport and Airway Trust Fund (26 U.S.C. 9502) until it is officially set aside for the purposes listed in those sections. Fund money may only pay for the programs and activities in this chapter. The Department of Transportation may use Fund money for its own administrative costs only as section 48104 allows. For any fiscal year that begins after September 30, 1998, the Secretary of Transportation can obligate or spend amounts appropriated under section 48104 only if a law explicitly amends section 48104.

(a)Amounts equal to the amounts authorized under section 48101–48105 of this title remain in the Airport and Airway Trust Fund established under section 9502 of the Internal Revenue Code of 1986 (26 U.S.C. 9502) until appropriated for the purposes of section 48101–48105.

(b)(1)Amounts in the Fund may be appropriated only to carry out a program or activity referred to in this chapter.

(2)Amounts in the Fund may be appropriated for administrative expenses of the Department of Transportation or a component of the Department only to the extent authorized by section 48104 of this title.

(c)In a fiscal year beginning after September 30, 1998, the Secretary of Transportation may obligate or expend an amount appropriated out of the Fund under section 48104 of this title only if a law expressly amends section 48104.
