The Secretary must study whether using trains dedicated only to moving high-level radioactive waste and spent nuclear fuel is safer than using other rail methods. The Secretary must work with the Secretary of Energy, the Nuclear Regulatory Commission, affected States and tribes, rail industry reps, and shippers. A report on the study must go to Congress by November 16, 1991. After looking at the study, the Secretary must update rail safety rules as needed by November 16, 1992, including rules for those dedicated trains. high-level radioactive waste and spent nuclear fuel — same meanings as in section 2 of the Nuclear Waste Policy Act of 1982 (42 U.S.C. 10101). By November 16, 1991, the Secretary must also require rules that any truck used to carry a highway-route-controlled amount of radioactive material in commerce be inspected and certified before each use. Inspections may be done by an authorized federal inspector or under state procedures. The Secretary may let the transporter inspect and certify the vehicle, but the person doing the inspection must meet the Secretary’s qualification rules.
