Title 49 › SUBTITLE VIII — PIPELINES › CHAPTER 603 — USER FEES › § 60301
Requires the Secretary of Transportation to set fees for all natural gas and hazardous liquid pipelines covered by chapter 601. Fees must be based on how much a pipeline is used (for example, volume‑miles, miles, revenues, or a mix). The Secretary must consider the Department of Transportation’s resource needs. Each operator of a gas transmission, liquefied natural gas, or hazardous liquid pipeline must pay the fee for the fiscal year, and it must be collected before the end of that fiscal year. The Secretary will set the collection rules and may hire a federal, state, or local agency to collect the fee and pay them a reasonable amount. Money from gas pipeline fees may only pay for gas-related activities under chapter 601, and money from hazardous liquid pipeline fees may only pay for hazardous-liquid activities under chapter 601. Fees can be spent only if Congress provides the funding in an appropriation law. Fees must cover the costs of those activities, but total fees collected in a year cannot be more than 105 percent of the appropriations for those activities that year.
