Certain officials must seize any plane, vehicle, or boat used in breaking the law and put it in the care of someone they pick. The Secretary of the Treasury or the governors of Guam or the Northern Mariana Islands must do this. If the offense involves certain kinds of illegal goods, the Attorney General or another authorized enforcer can also seize the property. The government will keep (forfeit) the seized item unless the owner proves someone else, not the owner, committed the offense while the item was in that person’s possession and that person had gotten the item by breaking a U.S. or State criminal law. Vehicles or vessels used by a common carrier for paid transportation can be taken only when: (1) for planes and most vehicles, the owner, conductor, driver, pilot, or person in charge knew of or agreed to the illegal act; (2) for a rail car or engine, the owner knew of or agreed to it; or (3) for a vessel, the master or owner knew of or agreed to it.
