Title 50 › Chapter 32— CHEMICAL AND BIOLOGICAL WARFARE PROGRAM › § 1528
The Secretary of Defense must notify the congressional defense committees within 45 days after a covered report of any theft, loss, or release of a biological select agent or toxin is filed with the Centers for Disease Control and Prevention or the Animal and Plant Health Inspection Service. The Secretary must provide the notice through the Assistant Secretary of Defense for Nuclear Deterrence, Chemical, and Biological Defense Policy and Programs. A release only requires notice if it left secondary containment into the air or environment or caused workplace exposures that threaten public safety. A "covered report" means a report filed under 7 C.F.R. §331.19, 9 C.F.R. §121.19, or 42 C.F.R. §73.19. The notice must include the agent or toxin name and identifying details (for example, strain), an estimate of how much was stolen, lost, or released, the location or facility, for releases any hazards and how many people might have been exposed, and the actions taken in response.
