Title 50 › Chapter 10— HELIUM GAS › § 167c
The Secretary must charge anyone who uses helium storage, withdrawal, or transportation services a fee that reflects the services’ economic value. Fees must at least cover all costs, including money spent on upgrades and maintenance of the Federal Helium System. Before any sale or auction of helium, the Secretary must publish a standard fee schedule each year. All fees collected go into the Helium Production Fund. The Secretary must allow buyers or winning bidders to store crude helium in the Federal Helium Reserve. The Secretary must set a transport and delivery schedule to make sure auctioned and other purchased helium arrive on time and must give priority pipeline access to federal in‑kind sales. Requests to use the Federal Helium Pipeline must be handled consistent with the planned phase-out of commercial sales and asset disposition.
