Most money from this federal retirement fund cannot be sold, given away, or taken by lawsuits, garnishments, or other legal claims unless another federal law allows it. If a participant has a former spouse who is protected by a court order or a spousal agreement, that former spouse can get certain payments. Those include a share of an annuity under 2032(a), a survivor annuity under 2032(b) or (c), or a lump-sum credit under 2071(b). Also, a court decree, order, or court-approved property settlement can direct the Director to pay some or all service-based payments to another person. Those spousal or court-ordered payments only apply to pay periods that begin after the Director gets written notice and any extra papers the Director asks for. If a payment is made to someone under these rules, no one else can later try to recover that same money. A person who gets an annuity may also make allotments or assignments from it for purposes the Director allows.
