The Secretary of Energy can use DOE national security money, including funds for planning, engineering, and plant projects, to plan, design, and build any DOE national security construction project that must move quickly to protect public health and safety, meet national defense needs, or protect property. Before doing this, the Secretary must send a report to the congressional defense committees explaining the planned activities and why they are needed. The rule in section 2746(b)(2) does not apply to these emergency actions.
