Title 50 › CHAPTER 45 — MISCELLANEOUS INTELLIGENCE COMMUNITY AUTHORITIES › SUBCHAPTER II — PERSONNEL AND ADMINISTRATIVE AUTHORITIES › § 3334
The Director of National Intelligence must write rules within 270 days after December 20, 2019 to let intelligence community employees temporarily work in private companies, and let private-sector employees temporarily work inside intelligence agencies. The rules must cover swaps that help intelligence or counterintelligence work and should focus on fields like finance, acquisition, biotechnology, computing, artificial intelligence, business innovation and entrepreneurship, cybersecurity, materials and manufacturing, and any other tech fields the Director finds important. Details require a written agreement with the agency, the company, and the employee. The agreement must say the employee must return to federal service for at least as long as the detail or repay nonsalary and benefit costs unless the agency head waives the debt. The employee must protect classified and nonpublic information. Either side can end a detail at any time. Details must last at least 3 months and no more than 2 years, but can be renewed up to a total of 5 years and, in some cases, extended up to 5 years to meet critical needs. No one may be detailed more than 5 years total. A private employee detailed to an agency stays paid by their company and is treated as a federal employee for certain employment, ethics, criminal, financial, tort, and procurement laws listed in the statute. Private companies cannot charge the government for the pay or benefits they keep paying during the detail as a direct contract cost. Agencies must avoid conflicts of interest if they arise. The Director must try to include small businesses, may set rules for reimbursing small businesses, and must check whether the exchange helps the intelligence community. Definitions: "Detail" means a temporary assignment from agency to company or company to agency. "Private-sector organization" means a for-profit or not-for-profit organization. "Small business concern" uses the meaning in 5 U.S.C. 3703(e)(2).
