Require the leader of each covered department or agency to send annual reports by February 1 to congressional oversight committees about every special access program they run. The reports must show the total budget request for special access programs for the next fiscal year and, for each program, a short description, major milestones for procurement programs, the actual past costs, the estimated total cost, and cost estimates for the current fiscal year, the budget year, and each of the four succeeding fiscal years. Each February 1 the leader must also notify and justify any new special access program, give its current total cost estimate, and point out any similar existing programs or technologies. Before changing a program’s classification or declassifying information, the leader must tell the committees what will change, why, and any planned public announcement at least 14 days beforehand unless there are exceptional circumstances (in which case the notice can come later with an explanation). The leader must promptly report any change or end to the rules used to label a program as special access. Information may be withheld if it would harm national security, but the leader must still provide the withheld details and the reason to the committees. No special access program may start until the committees are notified and 30 days have passed. Definitions: “Congressional oversight committees” means congressional leaders, the authorizing and appropriations committees with jurisdiction, the Senate Committee on Homeland Security and Governmental Affairs, and the House Committee on Oversight and Government Reform. “Covered department or agency” means a federal department or agency that runs a special access program but does not include the Department of Defense, the National Nuclear Security Administration, or Intelligence Community agencies. “Special access program” means a program given extra classified access controls under the relevant Executive Order.
