The Secretary of Defense may spend Cooperative Threat Reduction funds for a project that reduces proliferation risks if the Secretary and the Secretary of State agree that the project will fix a serious new proliferation threat or help reach long‑standing nonproliferation goals, can be finished within 5 years, and is best done by the Department of Defense. These funds can be from the current fiscal year or leftover funds from earlier years. At least 15 days before the money is committed, the Secretary of Defense must tell the congressional defense committees in writing, and the Secretary of State must tell the House Foreign Affairs Committee and the Senate Foreign Relations Committee. The notices must explain why the project was chosen, what it will cover and how long it will last, and whether other legal authorities could be used and, if so, why they were not. If the project is routine military‑to‑military work, the Secretary of State’s approval is only needed when foreign non‑defense officials take part. The rule about making the determination does not apply to a state of the former Soviet Union.
