The Secretary of Defense must get all permits needed in a former Soviet Union state before spending more than 40 percent of the cost of any construction phase. For a new construction project, no more than 40 percent of the project's total cost may be charged to Cooperative Threat Reduction funds in any fiscal year until the Secretary figures out what permits will be needed for the project's lifetime and gets any permits required to start work from the host state. The Secretary may exceed the 40 percent limit if it is necessary for the national interest and he or she sends the congressional defense committees a notice with a full explanation. Definitions: "new construction project" = a project with no funds used as of November 24, 2003; "permit" = any local or national development, construction, environmental, land use, or similar permit needed for major construction.
