Title 50 › Chapter 50— SERVICEMEMBERS CIVIL RELIEF › Subchapter III— RENT, INSTALLMENT CONTRACTS, MORTGAGES, LIENS, ASSIGNMENT, LEASES, COMMUNICATIONS SERVICE CONTRACTS › § 3952
Protects servicemembers who paid a deposit or an installment before they entered military service on a contract to buy, lease, or bail property (including cars). It only applies if the payment was made before the servicemember began military service. Anyone who knowingly takes back the property or tries to do so in violation can be fined under Title 18, jailed for not more than one year, or both. A court can require repayment of some or all prior payments before ending the contract and letting someone retake the property. A court can pause the case if military service makes it hard to follow the contract and can make other fair orders to protect everyone’s interests.
