If a servicemember had health insurance the day before entering military service and that insurance ended while they were serving, the insurance must be put back in place when they leave the military. This reinstatement also covers any family members who were on the policy because of the servicemember. It does not apply to people covered under chapter 43 of title 38. Reinstated coverage cannot add a waiting time or exclude a health problem that began before or during service, as long as that exclusion wouldn’t have applied before service and the Veterans Affairs has not ruled the condition a service-connected disability under section 105 of title 38. An application to reinstate must be filed within 120 days after leaving service. Premiums for the rest of the original coverage period cannot be raised above the pre-service amount, except for general premium increases that affected others with the same plan.
