A government commission can take and decide claims for pay when a merchant seaman was captured, held, or interned by German or Imperial Japanese authorities (or their agents) during World War II after December 7, 1941. A "merchant seaman" is someone who worked as crew on ships registered to the United States or to governments friendly to the U.S. and who was a U.S. citizen on or after December 7, 1941 until death or the claim date. Payment follows the amounts and rules in section 4104(c) and (d). No payment can go to a seaman or their survivors if the person voluntarily and knowingly helped or served an enemy government without being forced. Claims had to be filed within one year after August 31, 1954. Approved claims are sent to the Secretary of the Treasury to be paid from the War Claims Fund (section 4110).
