Title 50 › CHAPTER 53 — TRADING WITH THE ENEMY › § 4307
Corporations, companies, trustees, and similar groups in the United States must send a sworn list to the Alien Property Custodian naming any officer, director, or shareholder they know or reasonably think is a citizen or resident of a country at war with the United States, or of an ally of such a country. The list must show how many shares each person owns. The President can set rules, can ask for lists about ownership as of February 3, 1917, and can demand updates after October 6, 1917. Names can be removed if the custodian is satisfied the person is not an enemy. Anyone in the U.S. who holds property for, or owes money to, such a person must report that in writing under oath within 30 days after October 6, 1917, or within 30 days after they get control of the property or the debt becomes due. The President may extend filing times by up to 90 days. Transactions with enemies done since the start of the war and before October 6, 1917, remain invalid unless the law or a license says otherwise. Transfers after October 6, 1917, that break the rules give no legal rights unless properly licensed. The President can require that enemy-owned money or property (including patents, copyrights, trademarks, shares, and claims) be given or seized and put in the care of the Alien Property Custodian. Companies must cancel enemy-held shares and reissue them to the custodian. People who are not enemies may voluntarily turn over enemy property with the President’s consent. Actions taken under the President’s orders or under these rules protect people from court liability, and payments or transfers to the custodian count as full discharge of the obligation. Enemies generally cannot sue in U.S. courts during the war except as the law allows; a licensed enemy may sue only about the licensed U.S. business. The President’s written notice that someone is believed to be an enemy gives a strong legal defense to those who receive that notice.
