All money the alien property custodian gets must be put into the U.S. Treasury right away. The Secretary of the Treasury can put that money into U.S. bonds or certificates of indebtedness under rules the President sets, and those securities should be sold and the money returned to the Treasury as soon after the end of the war as the President thinks practical. Other property of an enemy or an ally of an enemy must be safely held and managed by the custodian. The President can name banks or other suitable deposit places in the United States to hold securities or other non‑cash property. Those depositaries can collect interest or dividends but must turn any money in to the Treasury immediately. The President can require those depositaries to post bonds to protect the property. The custodian has the powers of a common‑law trustee to manage, use, or sell the property, subject to the President’s rules. Property sold (unless sold to the U.S.) must generally be sold at public auction to the highest bidder and only to American citizens after public notice where the property is located, unless the President decides otherwise. The custodian may reject all bids and resell if the President orders. Anyone who buys for a hidden principal, to resell to a non‑citizen, or to benefit a non‑citizen commits a misdemeanor and can be fined up to $10,000, jailed up to ten years, or both, and the property will be forfeited to the United States. Corporations and similar entities in the U.S. must, on demand and with the certificates, transfer shares into the custodian’s name. Sale proceeds and other receipts must be deposited in the Treasury, or, if the custodian orders in writing, paid to the Treasurer with the same effect. After the war, claims by enemies or their allies to money or property held by the custodian will be resolved as Congress directs, except that the President or a court may order specific transfers, and the Treasurer must repay licensees when the custodian so orders.
