Summary

Allows the Secretary, working with the Commerce Secretary, to set up a public database that names covered foreign persons involved in prohibited or reportable technologies. It can include a way for a named foreign person to ask to be added or removed. The public, including Congress, investors, and NGOs, must be able to send confidential evidence about whether someone should be listed. If created, the database is not a complete list of all covered foreign persons under these rules. Covered foreign person — a foreign person or entity that may fall under the rule. Prohibited technology — technology that is banned under the rule. Notifiable (reportable) technology — technology that must be reported under the rule.

(a)The Secretary, in consultation with the Secretary of Commerce, may establish a publicly accessible, non-exhaustive database that identifies covered foreign persons that are either engaged in a prohibited technology or a notifiable technology pursuant to this subchapter.
(b)The Secretary, in consultation with the Secretary of Commerce, is authorized to establish a mechanism for a covered foreign person to petition for their removal from or inclusion in the publicly accessible, non-exhaustive database described in (a).11 So in original. Probably should be preceded by “subsection”.
(c)The Secretary shall establish a mechanism for the public, including Congress, stakeholders, investors, and nongovernmental organizations, to submit evidence on a confidential basis regarding whether a foreign person is a covered foreign person in a prohibited technology or notifiable technology and should be included in the database described in subsection (a), if any.
(d)The database described in subsection (a), if any, shall not be considered to be an exhaustive or comprehensive list of covered foreign persons for the purposes of this subchapter.
