Title 50 › Chapter 58— EXPORT CONTROL REFORM › Subchapter II— ANTI-BOYCOTT ACT OF 2018 › § 4843
Anyone who willfully breaks, tries to break, plans to break, or helps someone break the rules in section 4842 faces criminal penalties. On conviction they can be fined up to $1,000,000. A person (not a company) can also be sent to prison for up to 20 years, or get both a fine and prison time. The President can also impose civil penalties for violating section 4842 or rules under this subchapter. Civil penalties can include a fine up to $300,000 or twice the value of the transaction (whichever is greater), revoking a license issued under subchapter I, or banning the person from exporting, reexporting, or transferring items controlled under subchapter I. These civil penalties or other sanctions can only be imposed after notice and an agency hearing under sections 554–557 of title 5 and are subject to judicial review under chapter 7 of that title. The President may make rules about how penalty amounts are set, based on how serious the violation was, how responsible the person was, and whether they cooperated with the government.
