Title 51 › Subtitle III — Administrative Provisions › CHAPTER 311 — SAFETY › § 31102
Controlled substance — drugs covered by the federal Controlled Substances Act as chosen by the Administrator. The Administrator must create a drug and alcohol testing program for Administration employees whose jobs involve safety‑sensitive, security, or national security work. The program must include testing before hiring, when there is reasonable suspicion, randomly, and after accidents. The Administrator must also set rules that require the same kinds of tests for contractor employees doing those jobs. If a confirmed test shows someone used alcohol or a listed drug in violation of law or federal rules, the Administrator must require suspension, disqualification, or firing when appropriate. Anyone found to have used such substances after December 9, 1991, cannot work in those safety, security, or national security jobs unless they finish an approved rehabilitation program. A person cannot return to their prior duties if they used while on duty, used after already doing rehab, refuse rehab, or fail to complete it. The Administrator must set up and run a rehab program and must publish rules describing minimum program requirements, including chances for treatment. Contractor programs are encouraged. Testing rules must protect privacy, follow the Department of Health and Human Services scientific guidance dated April 11, 1988 (and later updates), require labs to do both screening and confirmation tests, confirm positives with quantitative methods, split and secure samples in the tested person’s presence with a retained portion available for an independent retest if requested within 3 days, protect confidentiality, and use fair, non‑harassing selection methods. State or local rules that conflict with these federal rules are not allowed, and earlier regulations issued before December 9, 1991, may be continued or changed by the Administrator.
