Anyone who destroys, causes the loss of, or injures a System unit resource must pay the United States for response costs and damages. Equipment (for example, a vessel, vehicle, or aircraft) that causes the harm is also directly liable. A person is not liable if they prove the harm was only from (1) an act of God or act of war, (2) a third party’s act or omission despite the person having used proper care and the third party was not the person’s employee or agent, or (3) an activity authorized by Federal or State law. This liability is in addition to any other federal or state legal liability.
