The Secretary of the Interior may plan, buy land for, build, expand, improve, equip, run, control, and protect airports in the continental United States that are in or near System units when those airports are needed for the Department’s work. The words airport, project, project costs, public agency, and sponsor use the meanings in 49 U.S.C. 47102. The Secretary cannot buy or build an airport unless it is listed in the national plan of integrated airport systems made by the Secretary of Transportation under 49 U.S.C. 47103. Operation and upkeep must follow the standards and rules set by the Secretary of Transportation. To do this, the Secretary may get land or land rights, hire contractors, make agreements with other public agencies to build or run airports, and make other needed deals. The Secretary cannot acquire land by purchase, condemnation, grant, or lease without the consent of the State’s governor and the chief executive of the local political subdivision where the land is located. The Secretary may sponsor projects under subchapter I of chapter 471 of title 49, alone or with others, and may use contributed or appropriated funds to pay the sponsor’s share. Airports under the Secretary’s control must be public and open for use on fair, reasonable, and nondiscriminatory terms.
