§101512 Conveyance to States of Roads Leading to Certain Historical Areas

Summary

The Secretary can give to the state, county, city, or their agency any federal road that leads to a national cemetery, national military park, national historical park, national battlefield park, or national historic site run by the National Park Service. "State" here means a State, Puerto Rico, Guam, and the Virgin Islands. Before the road is handed over, the receiving state, county, or city must send the Secretary a written notice saying it will accept and maintain the road. The Secretary can set reasonable conditions for the transfer. Once the transfer deed is signed and delivered, any authority the State had given the United States over that road is returned and becomes the State’s again.
