The Secretary must write rules, working with the National Conference of State Historic Preservation Officers and the National Trust, for State Historic Preservation Programs. The Secretary will approve a State’s program only if it: (1) has a State Historic Preservation Officer chosen by the State’s top elected official who hires qualified staff; (2) has an adequate, qualified review board; and (3) allows public participation, including recommending properties for the National Register.
