Creates an independent Advisory Council on Historic Preservation. The Council includes a President-appointed Chair from the public; the Secretary; the Architect of the Capitol; the Secretary of Agriculture and seven other agency heads chosen by the President; one Governor and one mayor chosen by the President; leaders of key state, tribal, and national preservation organizations; four preservation experts; three other public members; and one member who represents an Indian tribe or a Native Hawaiian organization. Most agency or organization members may send a designated officer instead, but for the Secretary and the group of agency heads the substitute must be an Assistant Secretary or another top official. Appointed experts, tribal/Hawaiian representative, and public appointees serve 4-year terms. A Governor or mayor serves while in elected office, up to 4 years. Appointed members (except the Chair) may serve no more than two terms and stay on until a successor is named. Vacancies do not stop the Council and must be filled within 60 days. After January 20, 2017 the Chair is appointed by the President with Senate approval, serves full time at the President’s pleasure, is paid at Level V of the Executive Schedule (section 5316 of title 5), serves 4-year terms (reappointment once), and the Vice Chair (picked from certain members) fills in when needed. Thirteen members make a quorum.
