The Secretary of the Army may use the rules and standards from a 2002 program comment about Capehart and Wherry era housing (published June 7, 2002; 67 Fed. Reg. 39332) to cover all Army housing built between January 1, 1941, and December 31, 1948 on Army bases, including privatized military housing under subchapter IV of chapter 169 of title 10. From the date the Military Construction Act for Fiscal Year 2025 (division B of Public Law 118–159) became law until December 31, 2045, the Secretary may also use the rules from a May 4, 2023 program comment about Vietnam War era housing (1963–1975) (88 Fed. Reg. 28573) to cover Army housing built after 1975 on Army bases, including privatized housing under the same subchapter. As part of each report the Army must give under section 3(c) of Executive Order 13287 (54 U.S.C. 306101 note), the Secretary must send the Advisory Council on Historic Preservation a report on how these authorities are being used. The law does not stop or force the Secretary or the chair of the Advisory Council on Historic Preservation from changing the Office of the Assistant Secretary of the Army for Installations, Energy and Environment documents mentioned above.
