Title 54 › Subtitle III — National Preservation Programs › CHAPTER 3201 — POLICY AND ADMINISTRATIVE PROVISIONS › § 320102
The Secretary, working through the Director, must use powers needed to carry out the national preservation policy. The Secretary must collect and keep drawings, plans, photos, and other records about historic and archaeological places, buildings, and objects. The Secretary must survey sites to find those with exceptional national value and research them to get accurate facts. The Secretary may acquire property by gift, purchase, or other means if the title is acceptable. Property owned by religious or educational groups, or held for public benefit, cannot be taken without the owner’s consent. The Department cannot agree to buy property or enter contracts that would obligate the Treasury’s general fund unless Congress has provided the money. The Secretary may make contracts or cooperative agreements with states, local governments, groups, companies, or people (and require bonds if needed) to protect or run sites, even if the United States does not own them, but again only if Congress has provided funds when needed. The Secretary must restore, rebuild, repair, preserve, and care for important historic and archaeological places and may set up museums at those sites. The Secretary must put up and keep markers to note important places and events. The Secretary may operate sites for the public, charge reasonable fees, and grant concessions, leases, or permits for land, buildings, roads, or trails; those deals can be made without advertising or competitive bids. When managing a donated site is too hard, the Secretary may create a corporation under District of Columbia or state law to do the work. The Secretary must also create an education program to share information about nationally significant sites and may charge reasonable fees for that information. Finally, the Secretary must take any other actions and make rules allowed by this law that are needed to carry out these duties.
