§1144 Limitation on Fines and Civil Penalties

Summary

Inspectors may not fine public transportation agencies unless the steps below are followed. The Secretary cannot impose civil penalties on a public transportation agency until the Secretary sends a written notice about the violation and gives the agency a reasonable time to fix it or offer another way to comply that the Secretary accepts. If the agency does not fix the problem or propose an acceptable alternative within the time named in the notice, the Secretary may use any enforcement actions allowed by section 114 of title 49. The Secretary must not start civil enforcement over administrative or procedural rules about applying for or spending money from transportation security grant programs under this subchapter.
