The head of U.S. Customs and Border Protection, working with the General Services Administration, can accept donations of property, money, or services for use at certain ports of entry: new or existing sea or air ports, existing federal land ports, and new federal land ports if a donation’s fair market value is $75,000,000 or less and total donations for that land port over the prior five years do not exceed $75,000,000. Money donations cannot be used to pay CBP employee salaries. Donations can pay for things like furniture, equipment, technology, their installation, operation, and upkeep, and for construction, repair, or operation of port facilities. Donations of property at GSA-owned land ports must be accepted by GSA. The authority to start new donation agreements ends on Dec 31, 2026, but proposals accepted for consideration before that date may continue. Agreements may last as long as needed. CBP and GSA must make public rules for choosing donors, assigning roles, handling risks and disputes, and ending agreements if donors don’t meet terms or security rules. They must tell a proposer within 60 days if a proposal is complete and, within 180 days after a completed proposal, approve or deny it. Donations can be returned without interest. Before taking donations, CBP must tell Congress that the donation won’t fund a detention center or a border fence or wall, and that the donor will pay operating and repair costs until told otherwise in writing. CBP and GSA must report yearly to Congress. The Government Accountability Office will review donations and fees every two years. Acceptance choices are discretionary and not subject to court review.
