§321f Nuclear Incident Response

Summary

When the Secretary orders it during a real or threatened terrorist attack, major disaster, or other emergency in the United States, the Nuclear Incident Response Team must work as part of the Department and must follow the Secretary’s direction and control. That does not stop the Secretary of Energy and the EPA Administrator from their usual jobs of organizing, training, equipping, and using their parts of the team, or from leading those parts when they are not working as part of the Department unit, unless other parts of this subchapter say otherwise.
