When the Secretary directs the Nuclear Incident Response Team during a real or threatened terrorist attack, major disaster, or other emergency in the United States, the Team must operate as a unit of the Department and follow the Secretary’s direction. That does not stop the Secretary of Energy or the Administrator of the Environmental Protection Agency from preparing, equipping, training, or managing their parts of the Team, or from leading those parts when they are not operating as the Department’s unit, under this law.
