The Secretary must run and manage this part of the law. The Secretary may pick certain anti‑terrorism technologies to get protection under the law’s risk‑management program if they meet criteria such as prior U.S. government use or proven usefulness; being ready for immediate public or private use; posing very large or hard‑to‑measure liability risks to sellers; likely not being used without the protections; creating big public risk if not used; being testable for effectiveness; and helping prevent, stop, or respond to terrorist acts. The Secretary may write rules to carry out this part after notice and comment under section 553 of title 5.
