The Department must make its yearly Federal response plan follow section 319 of the Public Health Service Act (42 U.S.C. 247d). All relevant agencies must share information. If the HHS Secretary declares a public health emergency under section 319(a) of the Public Health Service Act (42 U.S.C. 247d(a)), HHS must keep agencies like DHS, DOJ, and the FBI fully up to date. If a situation might be a public health emergency but no declaration is made, those agencies must keep the HHS Secretary and the CDC Director fully up to date.
