The Secretary may make cooperative agreements with the Secretary of Agriculture or with state agriculture departments, after consulting the state agency in charge of homeland security, to carry out these rules. When possible, the Secretary should work with state agencies that oversee ammonium nitrate facilities for registration and enforcement. The Secretary may give a State authority to help run and enforce the rules. If a Governor asks and the State can do the work, the Secretary must delegate the functions under sections 488a and 488b. If money is available, the Secretary must provide the State with enough funds to do the delegated work. The Secretary must give each owner of a registered ammonium nitrate facility guidance on spotting suspicious purchases or transfers, what to do (including refusing the sale and notifying law enforcement), and other steps to prevent misuse in terrorism. The Secretary should use relevant existing materials and programs when possible. The Secretary must also supply materials suitable for posting where ammonium nitrate is sold that explain the record-keeping rules under section 488a and the penalties for breaking them.
