Title 6 › CHAPTER 1 — HOMELAND SECURITY ORGANIZATION › SUBCHAPTER XV — HOMELAND SECURITY GRANTS › Part A — Grants to States and High-Risk Urban Areas › § 609a
Creates a federal grant program that gives money to certain nonprofit groups so they can strengthen physical and cyber security and protect against terrorist attacks or other threats. Eligible nonprofits are groups that are tax-exempt under 26 U.S.C. 501(c)(3) and that the Secretary finds are at risk. Grants can pay for strengthening buildings and security equipment, screening and inspection systems, security and cyber training, facility security staff, up to 5% of the grant for grant administration, and other approved activities including cybersecurity resilience. Each State may keep up to 5% of each grant for administration. If the Administrator sets target allocations, a State may ask to use part of its share for outreach and technical help when not enough eligible applications come from nonprofits outside high‑risk urban areas; outreach should focus on underserved and underrepresented groups. Grant funds must be usable for at least 36 months. The Administrator must set up a program office in FEMA within 120 days after December 23, 2022, led by a senior official to run the program, do outreach and training (including web videos), protect civil rights, give feedback to applicants who don’t get awards, collect data on grant effectiveness, set baseline rules for States, audit to prevent fraud, and promote diverse applicants. The Administrator must publish grant guidelines each year before awards. The Administrator must report annually for fiscal years 2022 through 2028 to congressional Homeland Security committees on spending, application counts, and program operations. Congress authorized $360,000,000 per year for grants for each of fiscal years 2023–2028 (split $180,000,000 for recipients in high‑risk urban areas that get funding under section 2003 and $180,000,000 for others), plus $18,000,000 per year for FEMA operations and support for those years.
