Title 6 › CHAPTER 1 — HOMELAND SECURITY ORGANIZATION › SUBCHAPTER XVIII — CYBERSECURITY AND INFRASTRUCTURE SECURITY AGENCY › Part D — Cyber Incident Reporting › § 681b
Covered entities must tell the Agency about certain serious cyber incidents and ransom payments on strict timelines. If they reasonably believe a covered cyber incident happened, they must report it within 72 hours. If they make a ransom payment after a ransomware attack, they must report that payment within 24 hours. If new important facts appear, or a ransom is paid after an earlier report, the entity must quickly send updates until it tells the Agency the incident is over and fully fixed. The entity must keep relevant data as the final rule tells them. If a ransom payment and the incident fall under both rules, one report may satisfy both if done the way the final rule allows. If a covered entity already reports very similar information to another federal agency and a sharing agreement is in place, the new reporting may not apply once the sharing system is active. The Director can also exempt certain Domain Name System functions run by multistakeholder groups. The Director must make rules to explain who must report, what kinds of incidents count, what details reports must include, how long to keep data, how and when to send updates, and how reports are submitted (including a simple web form). The Director had to publish a proposed rule within 24 months after March 15, 2022, and issue a final rule within 18 months after that proposal. The rules will also cover enforcement, privacy protections, how third parties can submit reports for a covered entity (and that the covered entity remains responsible), and an outreach campaign to tell likely covered entities and service providers about these duties. Federal cybersecurity authorities and other executive actions are not changed by these reporting rules.
