Title 6 › CHAPTER 3 — SECURITY AND ACCOUNTABILITY FOR EVERY PORT › SUBCHAPTER II — SECURITY OF THE INTERNATIONAL SUPPLY CHAIN › Part A — General Provisions › § 945
Create and run a program called the Container Security Initiative (CSI) to find and inspect ocean containers that might be a security risk before they are loaded at foreign ports to be sent to the United States. CSI can pick foreign seaports to take part after checking factors like the risk of terrorist compromise, how much cargo moves through the port, Coast Guard assessments, the host government’s cooperation and employee integrity programs, and whether the Department can verify the port’s security practices. The Secretary must tell Congress about any port added to or removed from CSI before telling the public. The Department may negotiate with foreign governments to make sure ports meet CSI rules. Ports in CSI must use nonintrusive inspection tools (like x-ray scanners) and radiation detectors that meet minimum technical standards, and those tools and procedures must be monitored. The Department will work with the Department of Energy on radiation detection and may get equipment through DOE programs or from private or host-government sources. The Department must make a staffing plan for U.S. and overseas personnel and hold yearly talks with host countries about best practices and needs. Cargo from CSI ports may be treated as lower risk for U.S. clearance. The Secretary must issue “do not load” orders to stop high-risk cargo from being loaded unless it is scanned, searched, or cleared with other information. A report was due not later than 270 days after October 5, 2018, covering technical assistance, staffing plans, inspection requests and results, effectiveness of screening and effects on trade, security incidents, reasons for keeping ports in CSI, remote targeting potential, and trade compliance problems. Funding authorized: $144,000,000 for FY2008, $146,000,000 for FY2009, and $153,300,000 for FY2010. Defined term: Container Security Initiative (CSI) — a program to identify and inspect risky maritime containers abroad before shipment to the U.S.
