Creates a Tier 3 level in C‑TPAT. The Secretary, through the Commissioner, must set rules to make a participant Tier 3. To qualify, a company may need stronger security than Tier 2—especially tighter control over who can access cargo—plus extra cargo information before loading, use of approved container security devices or technology, and any other cargo rules the Secretary sets. After talking with two advisory committees, the Secretary can give Tier 3 members extra benefits like faster release at U.S. ports at all threat levels, fewer or priority inspections, lower Automated Targeting System risk scores, and joining joint incident exercises. Not later than 2 years after October 13, 2006, the Secretary must set the criteria and provide the benefits.
