The Secretary of Agriculture can complain to the Surface Transportation Board about prices, fees, rules, or other practices for shipping farm products and can pursue those complaints. If someone else files a complaint, the Board must tell the Secretary and let the Secretary appear and speak if asked. If the matter affects the public interest, the Secretary can become a full party in the case and can appeal the Board’s decision in court. The Secretary’s legal responsibility is limited to court costs. The Board may use the Department of Agriculture’s records and help, and the Secretary may assist farmers’ co‑ops in bringing complaints.
