Title 7 › CHAPTER 1 — COMMODITY EXCHANGES › § 12c
Exchanges, or the Commission if an exchange does not act, may suspend, expel, discipline, or deny access to people who are exchange members. Those actions must follow the exchange’s rules. The exchange must give written notice to the Commission and to the person within 30 days. The notice must say why the action was taken in the form the Commission requires. The exchange must make public its findings and the penalty, but it must not release the evidence except to the person involved and to the Commission. The Commission can review these exchange decisions on its own or when someone affected asks. After review it can confirm, change, cancel, or send the matter back to the exchange, and its order will control how the exchange proceeds, subject to court review. The Commission can also pause the exchange action while it reviews. The Commission must make rules requiring each registered entity to publish a list of major violations. Anyone found to have committed a major violation is barred, for a time the Commission sets, from serving on the governing board or on a disciplinary committee of any registered entity or registered futures association.
