§136w–7 Department of Agriculture Minor Use Program

Summary

The Secretary of Agriculture must make sure the Department coordinates work on pesticides used for minor crops or uses. That includes running the IR–4 project and the national pesticide resistance monitoring program, backing integrated pest management research, working with growers to create needed data for minor uses, and helping with registrations, tolerances, and reregistrations with the Environmental Protection Agency. The Secretary, after talking with the Administrator, must set up a grant program to pay for data needed for minor-use pesticide registrations and reregistrations. Grants can cover no more than one-half of a project’s cost. Anyone may apply, but people who do not get money from selling minor-use pesticides get priority. Data made with a grant is owned by both USDA and the grantee, and the grantee must agree to share any fees they receive under the pesticide law. A Minor Use Pesticide Data Revolving Fund is created in the U.S. Treasury to hold appropriations and fees, available without fiscal year limits. Up to $10,000,000 may be appropriated each fiscal year for these purposes and remains available until spent.
