Title 7 › CHAPTER 35A — PRICE SUPPORT OF AGRICULTURAL COMMODITIES › SUBCHAPTER II — BASIC AGRICULTURAL COMMODITIES › § 1444a
Hold a vote of people who grew corn in 1958 by December 15, 1958. The vote asks if they want a price support program for the 1959 and later crops instead of acreage allotments and the old price supports. If fewer than half of the voters approve the new price support plan, three specific legal provisions named in the law will stop working. The Secretary must run a special research program to lower the cost of growing upland cotton as soon as possible. Up to $10,000,000 per year may be provided for that research, and the Secretary must report the results each year to the House and Senate agriculture committees. The Secretary must also run programs, through the Commodity Credit Corporation, to destroy cotton boll weevils and, when ready, pink bollworms or other major cotton insects. These programs will use federal, state, private agencies, and cotton groups. Producers and landowners in an eradication zone who get USDA benefits must join and cooperate to keep those benefits. The Secretary can require others to cooperate by making rules and can fine violations up to $5,000 per offense after notice and a hearing in the county, parish, or incorporated city where the person lives. If eradication actions cause a farmer to lose production or income, the Secretary must give fair compensation from project funds and protect the farm’s allotment, acreage history, and average yield. The Secretary will decide each zone’s cost and may require growers to pay up to half; each grower’s share can be taken from cotton payments or collected by rule. The program stops when the Secretary tells Congress the insects are completely eradicated. The Secretary may also work with Mexico on these efforts, arranging that work through the Secretary of State. The Commodity Credit Corporation may only spend money for these purposes if funds are provided, and Congress may appropriate funds as needed.
