Title 7 › Chapter 37— SEEDS › Subchapter I— DEFINITIONS › § 1562
You may not call seed "certified" on a label, ad, or other claim unless an official seed-certifying agency has checked it, found it meets required purity and identity standards, and the seed carries that agency’s official label saying its class and variety. If a variety must be sold only as certified seed under the Plant Variety Protection Act, it can be certified only when the basic seed was supplied with the owner’s permission during the term of protection and it meets any generation limits listed on the certificate.
