Sets rules for contracts to buy or sell cotton for future delivery on U.S. contract markets. Key terms: "cotton futures contract" is a sale of cotton for future delivery on a designated contract market; "future delivery" excludes cash sales for delayed shipment; "person" includes individuals and business entities; "Secretary" means the U.S. Secretary of Agriculture; "standards" means the official U.S. cotton grades. Every cotton futures contract must be in writing, show the quantity and the buyer and seller, and be signed to be enforceable. Contracts must be one of three types: basis grade, tendered grade, or specific grade. Basis grade contracts must name a basis grade from the official standards (middling is the default), show price per pound, the date, and the delivery month(s). Only cotton within allowed grades may be delivered; cotton that is badly damaged, below certain official grades, under seven-eighths of an inch staple, gin-cut, repacked, mixed, water packed, or otherwise reduced below low middling cannot be delivered. Sellers must give five business days’ written notice of delivery and, before final settlement, give a written list showing each bale’s grade and identifying marks. Government classifiers will check grades and their certificates are accepted as evidence. Price differences for grades are set by actual commercial differences found from spot cotton sales in at least five markets designated by the Secretary, using values on the sixth business day before delivery. The Secretary can name bona fide spot markets and make rules. People who deal in cotton must answer questions and produce records when asked; willful refusal or false answers can be fined up to $500. Knowingly breaking the Secretary’s regulations can bring a $100–$500 fine and, for individuals, 30–90 days in jail. Acts by employees count as acts by their company. Contracts made before this law took effect are not covered, and funds are authorized to carry out these rules.
