Livestock and poultry contracts that force arbitration must let a producer or grower say no to arbitration before they sign. The contract must clearly tell the producer or grower about this right. If a producer or grower declines, they can still agree later, in writing, to use arbitration after a dispute starts. These rules apply to contracts made or changed after the Food, Conservation, and Energy Act of 2008. If a packer, swine contractor, or live poultry dealer tries to stop a producer from choosing, that is an unlawful practice. The Secretary must write rules to carry out the law and to set standards for whether arbitration gives the grower or producer a real chance to participate fully.
