Within 90 days after May 13, 2002, and every year after, the Authority must name counties as distressed, nondistressed, or isolated areas of distress. Distressed counties are the most underdeveloped with high poverty, unemployment, or outmigration. Nondistressed counties are the others. Isolated areas are troubled spots inside nondistressed counties. At least 50% of funds made available under section 2009bb–12 must go to programs for distressed counties and isolated areas. The funding limit in section 2009bb–3(b) does not apply to projects that provide transportation, telecommunications, or basic public services to them. Also, at least 50% of section 2009bb–12 funds must be used for transportation, telecommunications, renewable energy, and basic public infrastructure projects authorized under paragraphs (1) and (3) of section 2009bb–2(a).
